Guest Confirmation Agreement

(Terms and Conditions)

In consideration of the monies received and the mutual promises contained herein, the owner (Owner) [Mountain Escapes] hereby agrees to give a license to use the Property to the undersigned, (herein referred to as Licensee), on the property and dates described in the confirmation letter and under the conditions stated herein.

Check-in: Check-in is no earlier than 4:00 PM EST on the arrival date.

          No early arrivals allowed unless authorized by Management.

Checkout: Checkout is NO LATER than 10:00 AM EST on the departure date.

Reservation Deposit:

A Non Refundable Reservation Deposit of $175 is required to hold an advance reservation if the reservation is made 15 days or more prior to date of arrival if booking through Mountain Escapes website.  Deposit requirements may vary if booking through travel websites. The Non Refundable Reservation Deposit is payable upon making a reservation. If payment is not received immediately, the booking can be cancelled without notice. *

Security Deposit:

In lieu of a cash deposit, Mountain Escapes uses a Non-Refundable $59 Damage Protection Program which covers $750 of incidental or accidental damage.  Managment MUST be notified of accidental damage during your stay or the damage may be deemed intentional. In addition, You hereby understand and grant consent for Mountain Escapes to charge your credit card in any amount of actual damages that are deemed intentional or vandalous in nature to the Property arising from your use of the Property, as well as for missing or broken items, excessive clean-up, and, if necessary, the cost incurred in removing you from the Property.  If necessary charges will be filed with the local authorities.  Mountain Escapes agrees to notify you of the charges along with an explanation. The property must be left in the same condition that it was in when the Licensee arrived.

Property Inspections:

All problems, including inadequate cleaning and damage, must be reported by phone to Mountain Escapes within 24 hours of check-in for prior guest to be held responsible. Mountain Escapes reserves the right to enter premises at any time for the purpose of effecting necessary inspections, repairs or maintenance.  All Guests shall abide by the Rental Rules (which is different than the Terms of Rental) which also explains the check in and check out procedures.  Failure to follow the rules can cause additional charges to the renter..  It is the renter’s responsibility to read and follow directions.

Pet Policy:

Pets are only allowed in “Pet Friendly” cabins and there is an additional pet fee associated.  Anyone bringing a pet into a property that does not allow pets will be charged whatever the management deems suitable for cleaning and an additional penalty for bringing an unwelcome pet on the premises and may be asked to leave the property without a refund or notice.

Occupancy:

The maximum number of occupants allowed in the Property is shown on the property page description. Children over the age of 3 are counted, however only guests 12 years of age and over are charged for as guests. Overcrowding or misrepresentation is grounds for immediate revocation of the license to the Property, and removal of Licensee without refund. Extra guests not included in the guest count will be considered as trespassors and will be removed by law enforcement. The Licensee is the person who will occupy the Property. Parents may not book Properties for their children. The Licensee must be present at the Property for the time of the reservation, and take full responsibility for the Property and his or her guests. Small children are the responsibility of the Licensee. The Properties may not be necessarily ‘child safe.’ Children should not roam free on balconies; climb on furniture; hang out of windows; wander onto neighboring properties: or engage in other unsupervised activities. Some units are not fit for children under certain ages due to expensive and/or delicate furnishings, and balconies with wide openings on the guard rail. Use is at your own risk. Licensee takes full responsibility for all lost, missing or broken items, and any damages to the Property of any kind.  

Restrictions on Property Use:

Licensees are prohibited from engaging in any unlawful activity or any other activity that constitutes a nuisance. Violation of this provision can and will result in immediate eviction without refund, additional charges over and above cleaning fees, and licensee will be held liable for any damages to the Property, contents and surroundings.  Under NO circumstances is it permissible to cut down live  trees or shrubbery on the property or neighboring properties.
